Privacy Policy

Zaker Chiropractic Pain & Wellness Center (“Zaker Chiropractic”, “we”, “us”, or “our”) respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy explains what information we collect through our website at https://zakerchiropractic.com (the “Site”) and through our communications with you — including our text messaging (SMS) program — how we use that information, and the choices you have.

This Privacy Policy applies to information collected through the Site and our marketing and communication channels. It does not replace the separate Notice of Privacy Practices that governs your protected health information (“PHI”) under the Health Insurance Portability and Accountability Act (“HIPAA”). Where information you provide is PHI, our HIPAA Notice of Privacy Practices and applicable law control.

1. Information We Collect

Information You Provide to Us

When you use our contact or appointment request forms, or otherwise communicate with us, we may collect:

Text Messaging (SMS) Information

If you opt in to our text messaging program, we collect your mobile phone number and a record of your consent (including the date, time, and method of opt-in).

Health Information

As a healthcare provider, we collect and maintain health information in connection with the care and services we provide. That information is “protected health information” and is handled in accordance with HIPAA, the California Confidential Medical Information Act, and our Notice of Privacy Practices — not this Privacy Policy. Please do not include detailed medical information in website forms or text messages.

Information Collected Automatically

When you visit the Site, we and our service providers may automatically collect device and usage information through cookies, pixels, and similar technologies — for example, your IP address, browser type, pages viewed, referring pages, and interactions with the Site. We use analytics and advertising tools (which may include Google and Meta/Facebook) for these purposes. See “Cookies and Tracking Technologies” below.

2. How We Use Your Information

We use the information we collect to:

3. Text Messaging (SMS) Program

We offer a text messaging program that you may opt into voluntarily by checking the consent box on our website form, by texting a keyword, or by providing written or verbal consent. Opting in to text messages is not a condition of receiving treatment or any other service.

Message types. We send two categories of messages: (1) transactional messages, such as appointment reminders, confirmations, follow-ups, and care, billing, or service notices; and (2) promotional messages, such as offers, wellness tips, and practice news, which are sent only to individuals who have separately consented to receive them.

Frequency and cost. Message frequency varies. Message and data rates may apply and are charged by your mobile carrier.

Opting out and help. You may opt out at any time by replying STOP to any message; we will send one confirmation message and then stop sending texts to that number. For help, reply HELP or contact us using the details in the “Contact Us” section.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties or affiliates. We may share your information only with subcontractors and service providers (such as our SMS platform provider) that support the operation and delivery of our messaging program, and only to the extent necessary for that purpose.

4. How We Share Information

We do not sell your personal information, and we do not share it with third parties or affiliates for their own marketing purposes. We may share information in the following limited circumstances:

As stated above, text messaging opt-in data and consent are never shared with third parties or affiliates for any purpose other than delivering the messages you have requested.

5. Cookies and Tracking Technologies

The Site uses cookies, pixels, and similar technologies to operate the Site, remember your preferences, analyze traffic, and support advertising and remarketing. You can control cookies through your browser settings and can opt out of many advertising cookies through industry tools such as the Digital Advertising Alliance (optout.aboutads.info). Disabling cookies may affect how the Site functions.

6. Data Security

We use commercially reasonable administrative, technical, and physical safeguards — including encryption and access controls — designed to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

7. Data Retention

We retain personal information for as long as needed to provide our services, communicate with you, and comply with our legal obligations. Medical and billing records are retained for the periods required by California and federal law. You may request deletion of information that is not subject to a legal retention requirement by contacting us. 10 year Retention Period.

8. Your California Privacy Rights

Depending on applicable law, California residents may have the right to request access to, correction of, or deletion of certain personal information we hold, and the right not to be discriminated against for exercising these rights. Medical information governed by HIPAA and the California Confidential Medical Information Act is generally exempt from the California Consumer Privacy Act. To make a request, contact us using the details below.

9. Children’s Privacy

The Site and our text messaging program are intended for individuals 18 years of age and older. We do not knowingly collect personal information directly from children online. For minor patients, information is provided and consent is given by a parent or legal guardian in the course of care.

10. Third-Party Links

The Site may link to third-party websites or services that we do not control. This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review their policies.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above and post the current version on this page. Your continued use of the Site or our messaging program after changes take effect constitutes acceptance of the updated policy.
